DUI/RECKLESS DRIVING
Completing ASAP is mandatory for all DUI offenses under Virginia State Code 18.2-271.1. Referral for entry into ASAP is court ordered after an individual has been convicted of a DUI.
When clients are court ordered to ASAP, they are given fifteen days from their court date to come to our office and enroll. At the court, they are given a restricted license or a form to enter into the program and either one is sufficient to enroll. When clients come to enroll, they will fill out intake paperwork, pay the ASAP fee*, and be given an intake appointment. If a client does not have the full fee at enrollment a payment plan application will need to be filled out.
In an effort to reduce wait times, all clients are encouraged to print out the enrollment packet and fill it out prior to coming to the office.
Prior to the intake appointment, client can watch a short orientation video that explains the ASAP program and what they can expect while involved in ASAP. Clients then meet on an individual basis with a case manager for an evaluation to set up their specific program. During their intake, a client is classified as either “Intensive Education” or “Treatment”. A variety of factors can influence their classification, such as prior DUI or drug convictions, last use of alcohol or drugs and BAC level at the time of arrest.
ENROLLING PRIOR TO CONVICTION
When a client is charged with a DUI or Drug Offense, many attorneys will suggest the client enroll prior to court. It is a benefit to the client to get the ball rolling as soon as possible after the incident occurs.
Clients wishing to pre-enroll will be required to pay their ASAP fee* at the the time of enrollment. They will also be required to provide a copy of the following:
- Arrest Warrant/Ticket
- BAC paperwork
- A current driving record and compliance summary from DMV no older than 30 days
- Vehicle Registration**
They will complete the enrollment process outlined above just the same way as someone who has been convicted. The clients are requested to notify their case manager when their court dates are and the outcome of court. At the individual’s request a progress report can be made available to the court on the trial date.
*The ASAP fee consists of a $300 enrollment fee and a $100 intervention fee.
Total Fees Due at enrollment: $400
**Effective July 1, 2025, clients can now pre-comply ignition interlock. That means that clients can work with ASAP to install a device prior to court so that they can begin accruing time for any potential court-ordered interlock at conviction. – Virginia Code 18.2-271.1 “Any installation period of time accrued by such person prior to trial shall count toward any ignition interlock or restricted license period of time ordered by a court or the Department of Motor Vehicles for the pending charge.”
DMV ENROLLMENT
For those clients who need to complete ASAP as a DMV requirement for a Virginia offense the following steps must be taken:
- Clients must enroll in the program where the DUI occurred. If the conviction was in another program jurisdiction, the client must provide a letter from that program stating there are no fees due and the client can enroll with JTASAP.
- The total ASAP fee is $400.00*, this along with any unpaid previous fees is due at enrollment.
- CLIENTS ARE INSTRUCTED TO NOT PAY THESE FEES ONLINE. THEY MUST BE PAID IN OFFICE AT TIME OF ENROLLMENT.
- ALL FEES ARE NON-REFUNDABLE.
- The client must provide a current (within 30 days) DMV Driving Record and Compliance Summary.
- Clients will then be scheduled for an intake appointment.

Multiple Offender/DUI 3rd/License Restoration Evaluations
Clients that are required to petition the court for restoration of driving privileges are required to complete an evaluation. Clients that petition Amelia, Augusta, Chesterfield, Colonial Heights, Dinwiddie, Emporia, Goochland, Greensville, Hanover, Henrico, Hopewell, Nottoway, Petersburg, Powhatan, Prince George, Richmond City, Staunton, Surry, Sussex, or Waynesboro will need to contact JTASAP to set up their evaluation appointment.
Upon enrollment the client will need to:
- Pay up to a $200 fee via money order, VISA, MasterCard, or Discover
- Complete Enrollment Documents
Clients will be given a copy of the license restoration questionnaire to take home to complete. Failure to complete this questionnaire in its entirety and bring it to the evaluation may result in the appointment being rescheduled. A $25 rescheduling fee will apply and this may delay the clients hearing in court.
