You are innocent unless proven guilty. This is the foundational principle of our system of justice, and one that we take very seriously. Constitutional Rights don’t assert themselves. They don’t protect themselves. Our rights are only as strong as those who stand up for them. At Bednarek Law Office, LLC, we don’t shy away from the fight. We are energized by the battle, by the confrontation that is often necessary to stand up for our clients, and for their rights. We have built our reputation on the respect that is given us by judges, prosecutors, law enforcement and other participants in the criminal justice apparatus — and we have earned that respect through many years of hard work, discipline, sound judgment, and aggressive defense of our clients’ cases. Most of all, we have built our reputation on our level of service to our clients — our commitment to do our best, every day, to achieve the best outcomes, to minimize the short and long-term negative consequences, and to defend their innocence.

Intoxicated Driving Offenses: We’ll Fight for You

Attorney Bednarek and Attorney Saperstein have a combined 30 years of experience defending clients charged with all manner of intoxicated driving offenses, both in State and Federal Court. We understand how stressful and life-changing this ordeal can be. The stakes are often higher than with many other criminal charges because there are mandatory jail sentences associated with a second or subsequent offense. In addition, a conviction will often result in the complete loss of driving privileges for months, sometimes years, and will usually require installation of a breath testing device (IID) for a similar period of time. Fines and fees associated with these convictions often will be in the thousands of dollars.

Our job is to minimize, if not entirely eliminate, the traumatic consequences that come with an OWI conviction.

Although the majority of cases are resolved without a trial, we will always encourage you to take your case to trial if we think that is the best way to defend you. Whenever possible we will attempt to cripple the prosecution’s case by filing “motions” to exclude evidence, motions to dismiss charges and motions to prevent prior offenses from being counted against you (“collateral attack”). Settlements (plea “deals”) range from reducing the penalties, eliminating IID requirements, amending an OWI to a less serious traffic ticket or outright dismissal.
