Protecting Immigrants Facing Charges of DUI in Tennessee Aggressive defense of your rights In Tennessee, we have some of the strictest DUI laws on the books and some of the harshest penalties. Those penalties can be magnified, however, if you do not have citizenship in this country. At the Nashville Law Office of Perry A. Craft, PLLC, we understand that you might be scared or anxious, and that you have a lot of questions about what happens next. We protect the rights of immigrants who are charged with DUI and traffic violations, and we keep you informed throughout the process of your case. You dont have to face this alone. The penalties of a DUI in Tennessee Tennessee DUI laws are very, very tough. If you are convicted of a DUI, you face: Mandatory jail time, even for your first offense Fines of up to $15,000 Mandatory road-side clean up (first time offenders only) Mandatory drug and alcohol counseling Loss of license for a minimum of one year Potential mandatory ignition interlock on your car There are also court costs, testing costs (if you submitted to a blood, breath or urine test), impound fees if your car was seized, and an increase in your insurance premiums. If you are a repeat DUI offender, a judge many sentence you to mandatory rehabilitation under the new DUI Recidivism Act, which allows a judge to convert jail time into rehab. What you cannot be, if convicted of a first-offense DUI, is deported. Removal can only take place if you commit a crime of moral turpitude, and a DUI is not indicative of that. If your record is clean outside of one DUI, you need not fear deportation proceedings. Exceptions that lead to deportation However, repeat DUIs may indicate a problem with substance abuse, which can lead to your removal from the country. If you damage property or hit another person while driving under the influence, you may be deported. If you are under the influence of illegal drugs, or if drugs are found on your person or in your car, you may also face removal proceedings. At the Law Office of Perry A.
