The following are the penalties for the criminal charge of DWI. This is not intended to be a legal education in every aspect of the DWI law regarding penalties. It is intended to give you enough information to see what you are facing.
DUI/DWI Services & Penalties (Louisiana)
Cypress Learning Center helps clients navigate DUI/DWI consequences including classes, community service, and court requirements.
First Offense (Misdemeanor):
- Fine: $300–$1,000
- Court Costs: ~$250
- Jail: 10 days–6 months
- Probation: Up to 2 years
- Community Service: 32 hours (half must be litter detail) or 48 hours in jail
- Other: Substance abuse evaluation/treatment, court-approved driver program, MADD Victim Impact Panel, possible license suspension, ignition interlock, SR-22 insurance
Second Offense (Misdemeanor):
- Fine: $750–$1,000
- Court Costs: ~$250
- Jail: 30 days–6 months (48 hours must be served)
- Probation: Up to 2 years
- Community Service: 240 hours
- Other: Same as first offense with stricter ignition interlock and license suspension
Third Offense (Felony):
- Fine: $2,000
- Court Costs: ~$250
- Jail: 1–5 years (1 year must be served)
- Probation: Up to 5 years
- Community Service: 240 hours
- Other: Substance abuse evaluation, inpatient + outpatient treatment, driver program, MADD Panel, ignition interlock, home incarceration, vehicle forfeiture
Fourth/Subsequent Offense (Felony):
- Fine: $5,000
- Court Costs: ~$250
- Jail: 10–30 years (2 years must be served)
- Probation: Up to 5 years
- Community Service: 320 hours
- Other: Same as third offense with extended incarceration and stricter penalties
