The consequences for a Wisconsin DUI/OWI conviction vary greatly by county, as well as by the type of license you have. The law frequently changes. Most of all, the quality of your legal representation can make a great deal of difference in the outcome.

Below is a rough breakdown of the penalties you face if convicted of drunk driving in Wisconsin:

  • First OWI offense: fine of up to $300; nine months driver’s license suspension.
  • Second OWI offense: fine of up to $1,100; up to six months in jail; eighteen months driver license revocation.
  • Third OWI offense: fine of up to $2,000; up to one year in jail; three year driver license revocation.
  • Fourth OWI offense: fine of up to $10,000; up to six years in prison; three year driver license revocation.
  • Fifth OWI offense: fine of  up to $25,000; up to ten years in prison; three year driver license revocation.

 

These penalties can increase substantially if certain aggravating factors are present. For example, if you had a passenger in your vehicle who was under the age of 16, if you have multiple offenses within five years or if someone was injured as a result of your drinking and driving, then you could face an even harsher sentence.
