DUI laws allow offenders to waive their right to an Administrative License Revocation (ALR) hearing and petition the court to allow the Sobriety Program Permit (SPP).

To be eligible for the SPP

  • There must be an Administrative License Revocation.
  • You must have a certified court order allowing the Sobriety Program Permit.
  • You must be a Nebraska resident.
  • You must be at least 18 years old and have been issued a license. Provisional Operator’s Permit holders are not eligible for the SPP.
  • The alcohol violation must have occurred in Nebraska.
  • Meet all other applicable reinstatement requirements for any non-alcohol suspension or revocation actions on your Nebraska driving record.
  • Must serve any required wait periods.
  • Cannot have driving privileges removed in any other state/jurisdiction.

If you meet the above requirements, or you need to check your eligibility for the SPP, call the Department of Motor Vehicles at 402-471-3985.

The Nebraska Department of Motor Vehicles (DMV) website provides specific details regarding the Sobriety Program Permit (SPP). This is a specialized driving permit that allows certain DUI offenders to maintain limited driving privileges by participating in a court-ordered sobriety program.

The Sobriety Program Permit (SPP)

The SPP is an alternative to the standard Ignition Interlock Permit (IIP). While the IIP focuses on a device in the car, the SPP is tied to the driver’s participation in a monitoring program (such as 24/7 sobriety testing).

  • Eligibility Requirements:

    • You must be a Nebraska resident and at least 18 years old.

    • You must have a certified court order specifically allowing the Sobriety Program Permit.

    • You must waive your right to an Administrative License Revocation (ALR) hearing.

    • The violation must have occurred within Nebraska, and you cannot have active suspensions or revocations in any other state.

  • Prohibitions: Holders of a Provisional Operator’s Permit (POP) are not eligible for the SPP.

Requirements for Authorization

To obtain the permit, you cannot go to a local licensing office first. You must submit the following directly to the Nebraska DMV in Lincoln:

  1. Certified Court Order: A true copy with the court clerk’s signature and seal.

  2. License Surrender: You must surrender your physical license to the Downtown Lincoln DMV office or sign an affidavit of a lost license.

  3. Wait Periods: You must serve any mandatory wait periods required by law before the permit can be issued.

Issuance & Fees

Once the DMV authorizes your application, they will send you an authorization letter. You can then have the permit issued either online through the DMV website or in person at a licensing office.

Document Type Fee Surcharge Total
Original Permit $45.00 $5.00 $50.00
Replacement $11.00 $5.00 $16.00
Class/Restriction Change $5.00 $5.00 $10.00

Important Legal Notes

  • SR-22 Insurance: If the court revokes your privileges, you must have your insurance company file a Proof of Financial Responsibility (SR-22) with the DMV. This must stay on file for three years from your reinstatement eligibility date.

  • Out-of-State Travel: The SPP is a Nebraska permit. If you plan to drive in another state, you must contact that state’s law enforcement to see if they recognize the permit.

If you are ready to apply, the central DMV office for processing these permits is located at 301 Centennial Mall South, Lincoln, NE 68509.
