Types of DUI Offenses in California
In California, there are seven types of DUI offenses:
First Offender DUI
Penalties can include up to six months of jail time, up to $1,000 in fines, suspension of a driver’s license, and a possible interlock ignition device required for any vehicle the driver uses.
“Wet Reckless” Driving
“Wet Reckless” is a slang term referring to a DUI charge that has been reduced to reckless driving. Penalties can include up to six months of jail time, up to $1,000 in fines, suspension of a driver’s license, and a possible interlock ignition device required for any vehicle the driver uses.
Second DUI
If your second DUI is within 10 years of your first, you will be charged with a misdemeanor Section DUI. Penalties can include mandatory jail time from 10 days to one year, a suspended driver’s license for two years, educational classes, fines up to $2,000, and a possible interlock ignition device required for any vehicle the driver uses.
Third DUI
A third DUI within 10 years of the first is still a misdemeanor offense but includes mandatory jail time from 120 days to one year, fines up to $3,000, revocation of a driver’s license for three years, educational classes, and a possible interlock ignition device required for any vehicle the driver uses.
Fourth DUI
If you are arrested for a fourth DUI within 10 years of the first, it is treated in the State of California as a felony DUI.
Felony DUI
A felony DUI occurs in one of three cases:
- A fourth DUI
- A DUI after a prior felony DUI conviction
- A DUI that caused injury or death
This offense carries a minimum of 180 days of jail time, $3,000 or more in fines, driver’s license revocation for four years, and educational courses. A felony DUI remains on a person’s permanent record. If the DUI causes injury, penalties can include up to 10 years in prison, up to $5,000 in fines, and compensation to injured parties.
Commercial DUI
For individuals holding a commercial driver’s license (CDL), the blood alcohol concentration limit is 0.04. Penalties are similar to a first DUI but may include loss of the CDL for a minimum of one year. Subsequent DUIs can permanently revoke the CDL.
Under Age 21 DUI
California has a zero-tolerance policy for underage drinking and driving. Because drivers under 21 cannot legally possess alcohol, these charges may include additional offenses such as minor in possession or use of false identification. Penalties can include a one-year driver’s license suspension, probation, fines, and possible jail time.
If you have recently been arrested for Driving Under the Influence—whether alcohol, marijuana, or other substances—we can get your services started today.
Upon meeting all DUI program requirements, you will receive a Certificate of Completion and a copy of the DL 101, which we submit on your behalf to the Court and the Department of Motor Vehicles.
Approved DUI Education Program
Our DMV-approved DUI Education Classes are California State Licensed programs for individuals convicted of a DUI who must complete a state-approved DUI program to restore driving privileges.
Any DUI conviction in a California court requires completion of a state-approved DUI program. Even if the court is no longer involved, the DMV remains involved until all requirements are met and a DL 101 proof of completion is submitted.
Riverside Recovery Resources offers:
- 12-hour Wet Reckless programs
- Three-, six-, and nine-month programs for first offenders
- An eighteen-month program for multiple offenders
